ANA Litigation Notice – Home

Status Update as of December 5, 2018:

On October 26, 2018, the United States District Court for the Northern District of California approved Plaintiffs’ proposed litigation class notice program regarding a class action lawsuit against All Nippon Airways Company, Limited (“ANA”).

If you do nothing, you keep the possibility of recovering money or other benefits that may result from a trial or settlement, but you give up any rights to sue ANA on your own about the same legal claims in this lawsuit. If you ask to be excluded from the lawsuit, and if any money or benefits later become available, you won’t be eligible to share in those, but keep your rights to sue ANA on your own about the same legal claims in the lawsuit. You must submit a Request for Exclusion no later than February 10, 2019.

If You Bought an Airline Ticket from the U.S. to Japan from All Nippon Airways or Japan Airlines Anytime from 2000 to 2007,

You Could Be Included in a Class Action Lawsuit.

You may have received a Notice regarding a class action lawsuit against ANA. This website will explain what the class action is about and will provide information about your rights and options in the lawsuit.

Settlements were previously reached with 12 Settling Defendants in class action lawsuits involving the price of transpacific airline tickets. More information about these Settlements is available here. The lawsuit continues against the remaining Non-Settling Defendant, All Nippon Airways. The Court has approved the lawsuit as a class action on behalf of a “class,” or a group of people, that could include you. The Court has not decided that ANA did anything wrong; rather, the case is currently scheduled to go to trial.

There are two Classes included in the lawsuit. You may be included if: (1) you bought a ticket for air travel from All Nippon Airways Company, Limited (“ANA”) or Japan Airlines between February 1, 2005 and December 31, 2007 and paid a fuel surcharge OR you purchased a ticket between January 1, 2000 and April 1, 2006 for a Satogaeri or “homecoming” fare; and (2) the ticket included at least one flight segment originating in the U.S. to Japan. Travel agents are only included if they bought tickets for their personal use.
